The Link Between the Fight Against Discrimination and the Ombudsman in Hungary

The fight against discrimination is an evergreen topic in western societies. The issue bears a particular relevance in Hungary, as the Hungarian Equal Treatment Authority was merged into the Hungarian Ombudsman Office in 2021, what significantly modified the institutional system for protection against discrimination. This organizational restructuring was met with vivid criticism at the time of its implementation as it created system problems that are not only dogmatically irresolvable but also hinder effective legal enforcement. The study examines the soundness of these concerns, the situation having evolved due to the restructuring, and the practice of the Commissioner for Fundamental Rights in discrimination cases. Although several years have passed since the Equal Treatment Authority was abolished, the issue can still be considered relevant as the problems have not been resolved since then. In fact, it can be stated that the enforcement of equal treatment requirements has more and more been pushed to the periphery of Hungarian law enforcement.
